Naming a book the same title as another one?

I know you can do that since I have seen books with the same name as others but are there any restrictions on it? I had given my book a title but then I found out another book written ten years ago has the same title but it's in a different genre with a different plot though.
 
There are no LEGAL restrictions, but publishers want to avoid it because same name books cause confusion. You'll want to make sure it's a VERY different genre. "Looking for Alaska" is both a Young Adult novel about a girl named Alaska, and a nonfiction book about the state of Alaska.

So if the genre of your book is different, then you should be okay.
 
I don't think there is anything wrong with it. It would be hard not to and it's the same with songs.
