Long Story; shortened.

Bought a Sony Playstation 3 in June 2007. Last week, it switched itself off and never restarted. A disc is stuck in the machine which I',m unable to retrieve. I'm happy that the SOGA applies to the machine, as it is fairly new, has been maintained as required and has failed in respect of durability... however......

I bought the PS3 from play.com, and contacted Sony first about the problem. Sony stated out of warranty, so tough (as far as they are concerned), but will offer me another unit for £150 as they are not able to repair it. I have therefore written to Play.com, asking for replacement, or £150 to buy the new unit from Sony.

Question is, if Play.com give me £150 for new unit, and I pass this to Sony for a new unit in exchange for my faulty one, does the SOGA apply to the new unit, and so would Sony be liable for problems of durability in future and not Play.com ? Would the 'new' machine be a 'sale' for the purposes of the act ?
