Volkswagen 2003 Passat doesn't start? ?

My passat wont start I don't hear a crank and when I turn the key nothing happens the heat will turn on and all indicator lights turn on. The weird thing about it is that the car will actually start sometimes and won't other times. I had a new battery installed by a mechanic who diagnosed it an found no problems, yet the problem still occurred the next morning. Any tips?
 
Sounds like a faulty neutral safety switch or one that is out of adjustment.

Try starting the car with gear selector in neutral and not park. With your foot firmly on the brake of course.
