WHAT CAN I DO!?! Cash America PAWN shop gave my Touch IPOD 8gb to SOMEONE ELSE!!!!?

I had to pay for classes in January and fell short of cash so I pawned my excellent condition IPOD as temporary relief. In case you don't know how a pawn shop works I will explain...you pawn an item for cash...like a loan and then you pay to money back within the terms of the loan. My loan was three months for $125. Once my financial aid came I went to pick up my IPOD and to my surprise they couldn't find it. ALLLL of my information was on there. I used it for everything. Now my Identity is at risk and all they say they can do is replace it with one that is used in the store!!! Can I sue them? My Identity is at risk because of their improper handling of my IPOD.
 
I am not a lawyer, but you need to first carefully read your contract with them. If they say in the contract that they are not responsible for lost or stolen goods, then there is not much you can do.

I know how pawn shops work, and I know you had to sign some type of contract.

If that is not in the contract, then yes, I suppose you can pursue legal action against them. Small claims would be the way to go.

As far as your information on the iPod, as soon as the person who bought it synced it to their iTunes, all that data was overwritten. It is flash memory, so it does not leave a residual trace like a Hard Drive would, so i would not worry too much about your private information. Best thing you can do if your really worried, is set up credit monitoring with a site like freecreditreport.com. It is not that expensive to do.

If you end up in small claims court over it, you can request the judge award you a years worth of credit monitoring at the Pawn Shops expense due to their negligence. It is worth a shot.
