When the cone of the cold air intake is behind the fender, are the chances of...

...hydrolocking any different? I have a 98 Mustang and the only cold air intake I found is supposed to be installed behind the fender. I just wanted to know if the chances of getting water in the engine are any higher.

If you go into a deep enough puddle it is possible. Try installing a splash sheild to prevent the filter from sucking uw any water.
