Who should I complain to?

I moved into my flat (a council flat), and in it was a folder containing confidential information about the previous tenant who needed home help.

10 months later the council have not enquired me if the info was still in my flat (not my job to tell them).

Hasn't my council violated a data protection principle or something? Could I possibly sue them?
I will name and shame them. It is East Ayrshire Council in South West Scotland.
The previous tenant died.
And yes it was left in a place where it could be easily seen.
 
Here in America, you can not sue unless you are the real party in interest.

Meaning it is your information that they are violating.

Its like if you see someone vandalizing your neighbor's house even if it offends you--you still have no legal standing to sue, only your neighbor whose home is vandalized may bring an action.
