...to borrow a CD from a friend? Next, they'll probably make that illegal too...
 
In one case you are borrowing something, and then returning it. Only one copy exists between you.

In the other you are duplicating content, i.e. making a copy. This is illegal if the file is protected by copyright and the copyright holder has not given permission.
 
Good question and that in a few words sums up the case for sttorneys of P2P sites.
actually, when you are borrowing your friend's stuff, it is not an illegal broadcast. (though unapproved sharing is also banned). When you use a P2P site you inadvertently broadcast or get intellectual property without permission.
Companies are not actually worried about you though......they are worried that if such sites are encouraged it will encourage piracy of copyrighted material
 
Because you don't give it back you keep a copy. The labels hate when the consumer is smart enough not to throw money away.
 
its not illegal to use P2P programs but it is illegal to download copyrighted material without permission.
