Will Apple/AT&T help me with my jailbroken iPhone 3's hardware problem?

I have a jailbroken iPhone 3 and the silencer switch is loose. This makes it so that it wiggles when in the silence position making it constantly switch between silence and not, which is really bad for class. If I bring it in to the store I bought it from will they fix the switch if it's jailbroken? Also if not what can I do?
 
Restore the phone and take it to them. Most likely they won't help you, so you may need to go to Apple directly.
