Can I sue her for defamation of character. She has told my boss and other coworkers. Everyday I have to here the comments being made about me. If I get it on tape would that stand up in court? I presently reside in GA
My boss never even spoke to me about the situation. My coworkers were speaking loudly in and around my cubicle making sly remarks. If this continues I will be filing charges against her

If you are actually damaged in some way, then definitely. The more substantial the damages, the better the case. For example, hurt feelings aren't worth much, but being passed over for promotion or good assignments is. Of primary interest here is that she told your co-workers. Telling a boss who is in a position to investigate and resolve the complaint isn't defamation, but starting a smear campaign with others for no reason other than to ruin you somehow certainly is. You should also take note that a defense to these lawsuits is the truth. So if they can establish that you took the phone, then you will lose.
