COLUMBUS, GA (WTVM) - A soldier set to deploy overseas is challenging her orders, arguing President Obama is not a natural-born U.S. citizen.

Captain Connie Rhodes' lawyer and army officials were set to face off in federal court in Columbus Friday but the proceedings stalled.

U.S. District Court Judge Clay Land held an emergency hearing but the captain, a doctor for the Army, wasn't there.

Her attorney says Rhodes is due at Fort Benning Saturday but was forbidden to leave Fort Riley in Kansas to attend Friday's hearing.

Orly Taitz, her lawyer, says instead of providing President Obama's vital records and proving that he is legitimate, the government is "intimidating and harassing" an officer.

"This is a doctor. This is a surgeon- a highly respected member of the community and they're basically subjecting her to a court martial and possible imprisonment if she disobeys her order and appears at the hearing. This should not be happening to any officer, to any enlisted," Taitz said.

Captain Rhodes is one of hundreds of service members represented by Taitz, all planning on filing similar lawsuits questioning President Obama's status as Commander in Chief.

Litigation for the Army said they were told Captain Rhodes did not request to be at today's hearing and that she still intended to get on her plane Saturday-her lawsuit continuing in her absence.

Judge Land says he wants Captain Rhodes present at the hearing so she can have her day in court and he can ask her some questions.

She is due at Fort Benning Saturday but will not actually deploy until next week.

Judge Land postponed the proceedings till Monday and issued an order for the captain to appear.

In July, Land dismissed a similar case for Major Stefan Cook, saying it lacked standing.

The government’s motion, filed by Maj. Rebecca Ausprung, with the Army’s Litigation Division in Washington, argues that the case should be tossed out because Rhodes already tried to get a temporary restraining order in a Texas court challenging her deployment. That court ruled Rhodes had no chance of success and denied the application, meaning that the captain can’t try again in Columbus, Ausprung states.

In addition, Ausprung states that Rhodes hasn’t shown that she’d suffer irreparable harm from being deployed.
 
What does Obama's citizenship have to do with an officers' orders to deploy overseas? Officers receive their commission from the Congress of the United States and their orders through their chain of command. They answer to the Uniform Code of Military Justice and may not appeal to a civil court to argue with their orders. This is one of the flimsier arguments I have heard of. Essentially the argument appears to be that no order in the military is lawful because of a perceived doubt in the Presidents citizenship status and the fact that the President is the top of the chain of command. The argument is flawed though because individual orders do not originate with the top of the chain of command. They originate with whomever has the authority to give the orders and authority is derived from congress not the president. This captain is going to end up in prison if she is not careful. Her argument is already moot because she has presumably followed some order given in the last 9 months so she must have a problem with this particular order and not the lawfulness of orders in general.

Whether or not Obama was born in Hawaii, this is not the way to challenge it. The birther argument is ridiculous anyway since Obama's mother is a natural born US citizen. He could have been born on Mars and still be legal. I have heard all of the arguments and they only work on people with no knowledge of the law. This is a classic example of a propaganda technique known as a "Big Lie"
