Can I buy an unactivated iPhone and use it as an iPod?

unfortunatley, apple & at&t don't allow that. the iPhone has to be actived before it can even work.

i broke my ipod touch and i want a new one so i was thinking that i could buy an iphone (unactivated) and use it as an i touch?
 
Yes, but you'd be better off just buying a new iPod touch. The price for the iPhone is a subsidized price that requires you to sign a 2 year contract. If you want an unlocked iPhone, you're going to have to go to Ebay or another auction site - and be mindful that you'll pay the UNSUBSIDIZED price, which will be around $600-$700. If you want a deal on an iPod touch, go to the Apple Store online - they've got a deal on refurbished 1st Gen iPod touches. You can get a 16GB for around $175.
