...Constitution & overrule religion & culture? What do you think of the Ninth Circuit Court Judge Vaughn Walker and his claims that the presuppositions of centuries of religious and cultural presuppositions in the definition of marriage are mere bigotry? Should one unelected person have that sort of authority to overturn precedents of law that are based on precedents of society? Is that right/moral/sensible/inevitable/virtuous/wise/whatever?
=====================================
Maggie Gallagher wrote of the decision:
"Those in power will call it tolerance, they will call it pluralism, but in truth same-sex marriage is a government takeover of an institution the government did not make, cannot in justice redefine, and ought to respect and protect as essential to the common good."
So how does government arbitrate "fairness" and "justice" and "rights" when religion, cultural values, human biology, contemporary beliefs about civil rights and justice when the various sources for our societal "ideals" are in apparent conflict with one another about what is "right", "moral", or "just"?
