how do you tell if a torrent is copyrighted?

i got caught downloading an aparently copyrighted movie. i found out it was copyrighted when i watched it. about a month later my father got an email saying he was being charged with downloading pirated films. how the hell did they find out? and how do you tell if a movie is pirated before you download it???

think, anything you get from a torrent is 99% illegally obtained.
purchase a copy of mp3 rocket d/l through their servers that you paid a one time license fee for, and make sure the copies are just for you, and under the fair use law
