I'm sorry but your fiance is lying. At child support hearings for failure to pay support they HAVE to serve you. They have to have a record of service or the whole thing just gets postponed, I just went through this last week. I took a day off from work just to hear the child support recovery people say "Oh, your honor, we were unable to serve that person"....DOH!
So, anyway, I was told that had the other person actually showed up they would have asked for the $1800 they were behind and work something out. If the person had been served and not showed up the Judge would have issued a warrant like your fiance got. You go to jail until you can get the arrears paid to child support recovery. And you stay in jail until you get the money together. I asked how is a person suppose to get the money if they are in jail and they said, they either make phone calls and beg and borrow the money, or they are found jobs and allowed to leave the jail during the day to work and report back there at night, and they do this for 6 months and then they get seen by the judge after another 3 months and if they have conveniently lost their jobs they get put back in jail.
There will be no option of time rather than paying. It isn't a fine he is needing to pay back to the court it is his child support commitement and the mother will be owed that money until the day the father dies, and even then she can sue his estate and get the life insurance money or even the house.
