...or loan, do I have to give it back? A so called friend of mine gave me a really nice bike back in August. Then we had a bad falling out and she doesn't like it, so she is asking for her bike back. Well, since I thought it was a gift, I had sold it in October because I needed a little money. She is threatening to call the cops on me, which is getting really annoying. Am I obligated by law to give it back to her if she has no proof it was just a loaned gift?

To clarify from the answers I have already received, I have asked her to drop it. I have also apologized that things have gone this way. We are two grown adults that just aren't compatible as friends anymore and I am truly sorry it happened this way, but it is a done deal. I don't believe I am a bad friend for selling the bike because she knew I have bills to pay and one month my checks were really small so I needed the cash. She wasn't even upset about it until she ruined our friendship and didn't like my response to it- which was to end our friendship.

If she has proof she is the owner, and denies she gave it to you and alleges out of spite that you stole it, and you admit you sold it -- your goose is cooked. The burden of proof that it was a gift , of which you have none, is on you to prove, not her.

I rather think that competent authority would refer the both of you to prosecutorial arbitration rather than court if you two cannot settle this between you. Are you ready for that considering charges could be filed if either of you happens to say the wrong thing to the right person? I seriously recommend you just let it go before you talk your way into an unnecessary hurt. A word from the wise should be sufficient.
