It's really a 50/50 chance. Apple can tell if you have jailbroken it before but only if they check and sometimes they don't check.

One thing though, the iPod will run a lot more efficiently if you don't jailbreak it.

You have to do a Full on Factory Restore To the NEWEST FIRMWARE.. Once you do that They is no way, Apple can detect your device has been jailbroken because all the Kernels are restored to default once you Factory restore.

So Your Warranty will be back, however be cautious because the IPod Might need more than 1 restore.
