Is the Cell Phone mine?

I was given a Iphone for my 18th birthday around December 17th that was on the gift givers plan on verizon. Now i want to switch the phone over to another plan. The owner of the plan is demanding i pay 160$ to switch it over but im certain that the phone is my property. I never agreed in writing to pay for my part of the bill but the plan owner assumed i would pay. I never payed anything.Since this phone is a gift, regardless of the plan it is on, is it my phone and can i do what i want with it?
 
The phone belongs to the person who signed the contract with Verizon.
 
Basically, someone has done a decent thing for you and you are throwing it in their face. You decide to change the plan and leave him stuck with paying a hefty penalty because you want to change and then claim "I never agreed to this".

Go ahead and switch, but you need to pay the penalty, because the original plan came with the phone. The person who gave you the phone is not responsible for paying for your new plan. You are.
