someone mentioned the need for medical evidence earlier.
and i guess the burden of dis-proof lies on the accused
remember women are fiercely guarded in these countries so the where-abouts of the women are usually known by the head male of the family. therefore she has a man's word to back her up

To suggest the "head male" of the family knows every movement a woman makes is just utter rubbish. When the "head male" of the family is out earning a crust, the woman is doing chores, shopping for food and supplies and doing all the other things expected of women.

In the West you only need 1 person, who doesn't have to be credible, in the Quran, you need four witnesses, all of whom have to be of good standing. It's a lot easier to get away with rape in the west (particularly in places like the UK), than it is in the Muslim world - of course that gets cancelled out by the lack of reporting of rape in the Muslim world because of the fear of shame and of potential reprisals.

There were laws passed not so long ago in Scotland designed to make it "easier" to get a rape conviction. Basically the thinking is if the woman you took home after a night out was drunk then you raped her because she was not sober enough to consent to sex. The woman of course still has to make the complaint. But if she claims she was out of her tree then the accused really needs to work hard to prove their innocence.

Sometimes, sometimes not. On the plus side, we don't stone women to death for adultery, or force them to marry the accused rapist, when they make a rape complaint to police but the jury finds that the State failed to prove guilt beyond a reasonable doubt.
