What is the punishment for stealing a cellphone?

so i left my phone in my friends car the other night and the next morning i called to ask if i could come pick it up and she said NO. Apparently somoene accidently spilled drinks all over her school books in the backseat of her car, where me and 3 other people were sitting. and my friend who was sitting in the front seat got her jacket dirty. She is telling me that i have to give her 200 dollors and pay for her dry cleaning or else she wont give me my phone back. it is a iphone 4s which was really expensive. first of all she has no proof i was the one who ruined her books and it wasnt my fault that her jacket got ruined. so i told i her i would call the police and press charges and she said she would press chargers on me saying i "vandalized her car". So basically she is stole my phone whereas it was an accident her books got ruined but she is trying to put it al on me. Do you think i could press chargers against her and what do you think the punishment would be??
 
Call the cops. She has your property. She has no possible means of proving any form of vandalism occurred. Turn her in, or call her parents, unless her parents are idiots who aren't likely to do anything about it.

The iPhone costs enough to be a felony, I think.
 
It doesn't matter that it's a cellphone. And she didn't steal it. You left it in her car.

What you have here is a civil matter.

Since the two of you are unable or unwilling to resolve this in an adult way, perhaps your parents need to talk to her parents.
 
It is your property even if she is keeping it from you. You could try to call the cops on her. The cops will laugh at her if she tries to say that a spilled drink that ruined her CLOTHES is vandalism of her car.

Keep a record of the conversation that proves she has your phone, if you don't have one, get proof of it by asking for your phone back again and recording the conversation.

You could take her to civil court over it, she could try to file a claim against you for her dry cleaning expenses, but without proof that you did it, and even if it was a mere accident, you are not at fault.

Depending on your local laws it could even be theft. Perhaps even a felony, as the phone is worth more than $500 full retail.
