What software does a sealed brand new iPhone 3GS come with?

I have someone wanting to sell me a brand new sealed iPhone 3GS, but it's FIDO and I need another carrier network so I need to unlock it. But in order to do so, it can't be 4+ software, it has to be 3 and etc. Since it's sealed, I'm assuming it has the standard 3.1.3 software on it, but is there a possibility that new 3GS comes with 4.0 or 4.0.1 software?
It's a 32gb
 
If it is an 8GB iPhone 3GS then it almost certainly has the 4.0 or 4.0.1 because they didn't start selling 8GB iPhone 3GS's until the iPhone 4 came out. If it is a 16 GB or 32 GB then it is probably the 3.1.3 software.
