when downloading torrent files in America?

when downloading torrent files in America you are not technically downloading any copy righted material at least until you actually add whatever movie books programs music and such to the torrent file program but the torrent file itself isnt actually illegal right
 
Torrents are not illegal, they're just peer-to-peer file sharing. I could share a picture of my cat via torrent and it's not illegal.

It's illegal to download and use and distribute pirated software. However, simply 'torrents' are not illegal unless they contain these illegal files.
