Why is my fish swimming near the top?

I just got a betta, and after putting him in the fish bowl and feeding him, i realized that he was only swimming on the top, occasionally turning on his side. I have to poke the tank a bit (while i know this is a bad thing) to make him move. Honestly, it looks like hes dozing off. What's going on??
 
It is the water that you used. If it was not de-chlorinated and you live in a city that treats large amounts of water this may be your problem. Letting water sit out for a few days usually helps a lot. I am saying this because your fish looks dead to me.
 
he is dying slowly but this could just be something that fishes do as in a few weeks it could be swimming round the tank like normal
