Ok, I purchased an iPhone 3Gs July 24th off a friend of mine. I purchased it used for $400. A few weeks ago I dropped the phone and shattered the glass. I went to get a quote from a cellphone shop, and it was quoted for $150. I decided to buy the part off ebay for $30 and pay $50 for his labour (cheaper). I known the guy for about 3 years, and he has fixed over 20 of my phones, me and him kick it off everytime we see eachother. So i dropped off the phone off with the part to be fixed on November 16th, It was only suppose to take 2 hours, but when i came back to pick it up he told me give him a couple days hes having problems. I waited a couple days and when i went to get it he was apparently "on vacation". His co-worker at the shop told me he had fixed the phone. I waited a couple more days and finally called and got ahold of him, he told me that the part was for the old iphone ( 3G) and that he installed a new part for the new phone and it comes to $100, It's in his car and he will bring it in friday the 27th. So friday I go to pick it up and Now hes telling me the phone is COMPLETELY toasted, meaning its for garbage. He said the part I gave him broke the phone because it was the old iphone glass. He lied to me and said he fixed the phone for $100 ( obviously he didn't) and is trying to blame the part for the break. I am blaming him for breaking the phone completly. Then he tells me "company policy, if you give me a part and I install it and break the phone its not my fault" I checked his official policies ( on a paper posted on the cashier) and this wasnt there and he never told me this BEFORE he broke the phone only AFTER. I asked him to give me the phone back in original condition ( working but with broken glass) and he said "NO", then i said I want $200 back, which is half what I paid for it. And again he said "NO". So i got into an argument with him, saying how he broke my phone because he didnt know what he was doing and was stalling because he knew he broke it.

Anyways, I want to go to court and try to get the retail phone for the phone ($780). The thing is I dont have a receipt of purchase from a store because i bought it off a friend but i do have warranty papers from apple. And my friend at the shop never gave me a receipt because this was suppose to take only 20 minutes.

if this goes to court, do you think I will win the case?
