...or loan, do I have to give it back? A so called friend of mine gave me a really nice bike back in August. Then we had a bad falling out and she doesn't like it, so she is asking for her bike back. Well, since I thought it was a gift, I had sold it in October because I needed a little money. She is threatening to call the cops on me, which is getting really annoying. Am I obligated by law to give it back to her if she has no proof it was just a loaned gift?

To clarify from the answers I have already received, I have asked her to drop it. I have also apologized that things have gone this way. We are two grown adults that just aren't compatible as friends anymore and I am truly sorry it happened this way, but it is a done deal. I don't believe I am a bad friend for selling the bike because she knew I have bills to pay and one month my checks were really small so I needed the cash. She wasn't even upset about it until she ruined our friendship and didn't like my response to it- which was to end our friendship.

Nope, she can call them, but unless she can prove she just loaned it to you temporarily she can't do nothing about it.

No, but you don't sound like a very good friend, selling a gift like that. If it was a gift.

She gave you the bike in August. Any witnesses? You'll need them. She is an Indian-Giver. Don't worry about it. Just document exactly what she said to you when the bike was handed over..

Gave you a bike for FREE.
Thought it was a gift?
Sold it.
Needed money.
Threatening to call cops.
LOANED GIFT.

It is either a gift or not a gift, once given to you, it becomes your property. Since you sold it, it was your to do as you saw fit. Needed money more then bike. Logical to assume that you felt it was given too you.
If she says it was loaned, how long was it owned for.
